This agreement applies to end users of white-label apps and FleetFlow-powered services connected to vehicle brands.
Introduction
This End User License Agreement ("EULA" or "Agreement") governs your use of mobile applications and services powered by FleetFlow B.V. (i.o.) ("FleetFlow") technology but provided by our customers ("Company", "Brand", or "Service Provider"). By downloading, installing, or using the App or Services, you agree to be bound by this Agreement.
Important: The Brand is the primary party responsible for customer support, account management, and your relationship regarding the vehicles and services. FleetFlow provides the underlying technology platform but does not directly manage customer relationships.

1. Definitions
"App" refers to the mobile application provided by the Brand and powered by FleetFlow technology
"Services" refers to the vehicle-related services, support, and features provided through the App
"Vehicle" refers to the bicycle, e-bike, scooter, or other vehicle manufactured or provided by the Brand
"User Data" refers to personal information, ride data, and other information collected through your use of the App and Services
"Test Ride" refers to temporary use of a Vehicle for evaluation purposes
2. License Grant and Restrictions
2.1 License Grant
Subject to your compliance with this Agreement, the Brand grants you a limited, non-exclusive, non-transferable, revocable license to:
Download, install, and use the App on your personal mobile devices
Access and use the Services in accordance with their intended purpose
Use the Vehicle(s) associated with your account as permitted by your service agreement
2.2 Restrictions
You agree not to:
Modify, reverse engineer, decompile, or disassemble the App
Use the App or Services for any illegal or unauthorized purpose
Interfere with or disrupt the App, Services, or underlying FleetFlow technology
Share your account credentials with others
Use the Services to harass, abuse, or harm others
Attempt to gain unauthorized access to any part of the system
3. Account and Data Responsibility
3.1 Primary Relationship
Important: Data Controller Relationship
The Brand is the data controller for your personal information and has primary responsibility for:
Customer support and account management
Vehicle service and maintenance
Billing and subscription management
Handling data access and deletion requests
3.2 FleetFlow's Role
FleetFlow provides the technology platform and:
Stores and processes your data on behalf of the Brand
Provides technical infrastructure for the App and Services
Implements security measures to protect your data
Does not have direct access to or control over your account with the Brand
4. Data Collection and Privacy
4.1 Data We Collect
Through your use of the App and Services, the following data may be collected and stored by FleetFlow on behalf of the Brand:
Personal Information: Name, email address, phone number, payment information
Service Data: Maintenance records, support tickets, communication history
Location Data: Real-time and historical location information during rides
4.2 Data Usage
Your data is used to:
Provide vehicle tracking and management services
Enable customer support and service functionality
Process maintenance and service requests
Improve vehicle performance and user experience
Ensure vehicle security and theft prevention
Comply with legal and regulatory requirements
4.3 Data Access and Control
Your Data Rights:
To exercise your data rights (access, correction, deletion, etc.), please contact the Brand directly through their support channels.
Through the Brand's customer support channels
Through the App's support features
Via the Brand's website or contact information
5. Test Rides
Important Safety Notice:
Test rides are conducted at your own risk. Please read this section carefully before participating in any test ride.
5.1 Test Ride Terms
Test rides are provided for evaluation purposes only
You must be at least 18 years old (or legal age in your jurisdiction) to participate
You must provide valid identification and agree to these terms
Test rides are subject to time limits and geographic restrictions
You are responsible for the vehicle during the test ride period
5.2 Safety and Liability
Assumption of Risk: You acknowledge that test riding involves inherent risks including but not limited to injury, property damage, or death
Vehicle Condition: You are responsible for inspecting the vehicle and ensuring it is safe to operate
Traffic Laws: You must comply with all applicable traffic laws and regulations
Safety Equipment: You are responsible for wearing appropriate safety equipment (helmets, etc.)
Proper Use: You must use the vehicle only as intended and not for any illegal activities
5.3 Limitation of Liability
To the maximum extent permitted by law, the Brand and FleetFlow are not liable for:
Personal injury or property damage during test rides
Accidents, collisions, or other incidents during vehicle use
Loss or theft of personal property during test rides
Improper use or misuse of the vehicle
Failure to follow safety guidelines or traffic laws
5.4 Data Recording During Test Rides
Vehicle location, speed, and performance data may be recorded during test rides
This data is used for safety, security, and vehicle improvement purposes
Data may be reviewed in case of incidents or for research purposes
Personal data from test rides is handled according to our privacy practices
6. Vehicle Usage and Maintenance
6.1 Proper Use
Use vehicles only for their intended purpose and within manufacturer specifications
Follow all maintenance schedules and service requirements
Report any damage, malfunctions, or safety issues immediately
Do not modify or tamper with vehicle components or software
6.2 Data Recording
Vehicles may continuously record location, speed, and performance data
This data helps ensure optimal performance and enables remote diagnostics
Data may be used for warranty claims and service optimization
You consent to this data collection as part of the service
7. Support and Service
7.1 Primary Support
For all support needs, please contact the Brand first:
Customer service and account issues
Vehicle problems and maintenance
Billing and subscription questions
App functionality and technical support
7.2 FleetFlow Support
FleetFlow provides technical support to the Brand but does not directly handle end-user support except in specific circumstances coordinated with the Brand.
8. Intellectual Property
The App and underlying FleetFlow technology are protected by intellectual property laws
The Brand holds rights to their brand, design, and customer-facing elements
You do not acquire any ownership rights in the App or Services
All feedback and suggestions you provide may be used without compensation
9. Termination
The Brand may suspend or terminate your access for violations of this Agreement
You may terminate your account by contacting the Brand's customer support
Upon termination, you must uninstall the App and return any vehicles
Data retention after termination is governed by the Brand's privacy policy
10. Disclaimers and Warranties
The App and Services are provided "as is" without warranties of any kind
We do not warrant that the App will be error-free or continuously available
Vehicle warranties are provided by the Brand according to their terms
FleetFlow disclaims liability for service interruptions or technical issues
11. Limitation of Liability
To the maximum extent permitted by law, neither the Brand nor FleetFlow shall be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, Services, or vehicles.
12. Governing Law
This Agreement is governed by the laws of the Netherlands. Any disputes will be resolved in the courts of the Netherlands, subject to applicable consumer protection laws.
13. Changes to This Agreement
The Brand may update this Agreement from time to time. Material changes will be communicated through the App or by email at least 30 days before taking effect. Continued use constitutes acceptance of the updated terms.
